These Terms and Conditions apply to all offers, orders, and agreements via 君JŪN.STUDIO. By placing an order, you agree to these terms.
1. Definitions
In these Terms and Conditions, the following definitions apply:
Seller: 君JŪN.STUDIO, hereinafter referred to as “Seller.”
Customer: any natural or legal person entering into an agreement with the Seller.
Products: goods offered by the Seller, including reed diffusers and home accessories.
Agreement: any agreement between the Seller and the Customer concerning the purchase of Products.
2. Applicability
2.1 These Terms and Conditions apply to all offers, orders, and agreements.
2.2 Deviations from these Terms and Conditions are only valid if agreed upon in writing.
2.3 If any provision of these Terms and Conditions is invalid or unenforceable, the remaining provisions shall remain fully in effect.
3. Offers and Agreements
3.1 All offers are without obligation and may be modified or withdrawn at any time.
3.2 An agreement is only concluded after written or electronic confirmation of the order by the Seller.
3.3 The Seller reserves the right to refuse orders without providing a reason.
4. Prices and Payment
4.1 All prices listed include VAT unless explicitly stated otherwise.
4.2 Payment must be made in full using the payment methods indicated on the website.
4.3 If payment is not made on time, the Customer is automatically in default without notice. The Seller reserves the right to collect outstanding amounts, including statutory interest and collection costs.
5. Delivery and Transfer of Risk
5.1 Delivery takes place at the address provided by the Customer.
5.2 Delivery times are indicative; exceeding them does not entitle the Customer to compensation or cancellation of the agreement.
5.3 The risk of loss, theft, or damage to the Products passes to the Customer upon delivery.
5.4 The Seller is not liable for damage resulting from delays or failures by transport services.
6. Right of Withdrawal and Returns
6.1 If the Customer is a consumer, the statutory 14-day right of withdrawal applies after receipt of the Product.
6.2 Products must be returned undamaged, unused, and in their original saleable packaging.
6.3 Return shipping costs are always borne by the Customer, except in cases of defective or incorrectly delivered Products.
6.4 The Seller is not liable for any depreciation of Products due to improper use or packaging during return shipment.
7. Warranty and Liability
7.1 The Seller guarantees that Products comply with legal requirements under normal use.
7.2 The Seller is never liable for indirect damage, consequential damage, loss of profit, business losses, or data loss.
7.3 Any liability of the Seller is always limited to the invoice amount of the relevant Product.
7.4 The Seller is not responsible for improper or incorrect use of Products, including fragrance, fire, or breakage damage.
7.5 The Customer uses the Products entirely at their own risk.
8. Intellectual Property
8.1 All texts, images, logos, and designs on the website are the property of the Seller or its licensors.
8.2 Copying, reproduction, or commercial use of these materials without express written permission is prohibited.
9. Privacy
9.1 Personal data is processed in accordance with applicable privacy legislation and the Privacy Policy on the website.
9.2 Personal data is used exclusively for processing orders and related communication.
10. Force Majeure
10.1 The Seller is not liable for non-performance due to force majeure. Force majeure includes, but is not limited to, war, terrorism, natural disasters, pandemics, strikes, supplier or transport disruptions, fire, power outages, and government measures.
11. Changes to Terms and Conditions
11.1 The Seller reserves the right to amend these Terms and Conditions at any time.
11.2 Amended terms apply automatically to new orders and are published on the website.
12. Applicable Law and Disputes
12.1 All agreements are governed exclusively by Dutch law.
12.2 Disputes are exclusively submitted to the competent court
13. Misuse of Products
13.1 The Customer acknowledges and agrees that 君JŪN.STUDIO is not responsible for any damage, injury, or loss resulting from improper, incorrect, or negligent use of the Products. All Products are used at the Customer’s own risk, and the Seller’s liability does not extend to misuse, failure to follow instructions, or unsafe handling of the Products.
